1. Agreement to Terms

These Terms and Conditions ("Terms," "Agreement") constitute a legally binding agreement between you ("User," "Client," "you") and SpeakPro Osaka ("Company," "we," "us," "our"), a professional communication coaching service registered in Japan (Registration No: 72540157) with principal place of business at Unit 65 116 Kuhlman Centre, Joeyhaven, QLD 2430, Japan.

By accessing our website at bestbravenode.pro, registering for services, or engaging with our coaching programs, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy, which is incorporated herein by reference.

2. Services Description

SpeakPro Osaka provides professional communication coaching services, including but not limited to:

• Interview preparation and coaching
• Public speaking training and development
• Oratory skills enhancement programs
• Personalized communication consultations
• Group workshops and training sessions
• Online and in-person coaching sessions
• Educational content and resources

Service offerings, availability, and specifications are subject to change at our discretion. We reserve the right to modify, suspend, or discontinue any service without prior notice.

3. Eligibility

To use our services, you must:

• Be at least 18 years of age
• Have the legal capacity to enter into binding contracts
• Provide accurate, current, and complete information during registration
• Maintain and update your information to keep it accurate and current
• Not be prohibited from using our services under applicable laws

By using our services, you represent and warrant that you meet these eligibility requirements.

4. Registration and Account Security

• Maintain and promptly update your account information

5. Booking and Scheduling

When booking coaching sessions or consultations:

• Sessions must be scheduled in advance through our designated booking system
• Booking confirmation will be sent via email
• Session times are subject to coach availability
• You must arrive punctually for scheduled sessions
• Late arrivals may result in shortened sessions without refund
• Repeated no-shows may result in service termination

6. Cancellation and Rescheduling Policy

For session cancellations and rescheduling:

• Client Cancellations: Cancellations must be made at least 24 hours before the scheduled session time for a full credit or refund
• Late Cancellations: Cancellations made less than 24 hours before the session will forfeit the session fee
• Rescheduling: Sessions may be rescheduled once without penalty with 24 hours notice
• Company Cancellations: If we must cancel a session, you will receive a full refund or credit for that session
• Emergency Situations: Exceptions may be made for documented emergencies at our discretion

7. Payment Terms

Payment policies include:

• All fees must be paid in advance unless alternative arrangements are agreed upon in writing
• We accept payment via credit card, debit card, and other designated payment methods
• Package purchases are non-transferable unless explicitly stated
• Prices are subject to change without notice; existing bookings honor the original price
• You are responsible for all applicable taxes
• Currency for all transactions is specified at time of purchase

• Refund eligibility depends on timing of cancellation and service type
• Package refunds are prorated based on unused sessions

9. Intellectual Property Rights

All content on our website and provided through our services, including but not limited to text, graphics, logos, images, audio clips, video content, data compilations, software, and training materials, is the property of SpeakPro Osaka or its content suppliers and is protected by international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use our services for personal, non-commercial purposes. You may not:

• Reproduce, distribute, modify, or create derivative works from our content
• Use our materials for commercial purposes without written permission
• Remove copyright or proprietary notices from materials
• Transfer, sell, or license any content to third parties
• Reverse engineer or attempt to extract source code from our software

10. User Conduct and Prohibited Activities

You agree not to:

Violation of these prohibitions may result in immediate termination of services and legal action.

11. Confidentiality

We maintain strict confidentiality regarding information shared during coaching sessions. However, confidentiality may be limited in the following circumstances:

• Where disclosure is required by law or court order
• To prevent imminent harm to you or others
• With your explicit written consent
• As necessary to enforce these Terms or protect our rights

You also agree to maintain confidentiality regarding proprietary coaching methodologies and materials shared during sessions.

12. Disclaimer of Warranties

OUR SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Implied warranties of merchantability or fitness for a particular purpose
• Warranties regarding accuracy, reliability, or completeness of content
• Warranties that services will be uninterrupted, timely, or error-free
• Warranties regarding results or outcomes from coaching services

While we strive to provide high-quality coaching services, we cannot guarantee specific results or outcomes. Success depends on many factors, including your effort, commitment, and circumstances beyond our control.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SPEAKPRO OSAKA SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Damages arising from your use or inability to use our services
• Damages resulting from unauthorized access to your data
• Damages arising from third-party conduct or content

You agree to indemnify, defend, and hold harmless SpeakPro Osaka, its officers, directors, employees, coaches, agents, and affiliates from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use or misuse of our services
• Your violation of any rights of third parties
• Your violation of applicable laws or regulations
• Any content you submit or transmit through our services

15. Termination

We reserve the right to terminate or suspend your access to our services immediately, without prior notice or liability, for any reason, including but not limited to:

• Breach of these Terms
• Fraudulent, abusive, or illegal activity
• Failure to pay applicable fees
• At our sole discretion for operational or business reasons

Upon termination, your right to use our services ceases immediately. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

Any disputes arising from these Terms or our services shall be resolved as follows:

• Informal Resolution: Parties agree to first attempt informal resolution by contacting us directly
